BOARD OF DIRECTORS MEETING
MINUTES

CALL TO ORDER:

ROLL CALL TO ESTABLISH QUORUM:
Directors present: Jim Ford, Robert Schettler, Gloria Dale Williams, and Mitch Welty.
Others present: Emory Gasser and Mike Wood of Gasser Property Management.
APPROVAL OF MINUTES FROM PREVIOUS MEETING:
Minutes from January 21, 2010 were previously approved via e-mail.
FINANCIAL REPORT:
A number of preventive maintenance and cosmetic issues were discussed. Roof repair and maintenance continues to put severe stress on the operating and reserve budgets.
In order to clarify what constitutes the Association’s and Owners responsibilities, the following has been extracted from the Declaration of Covenants, Conditions and Restrictions for Townhomes of Andover:
Article IV, Section 1. Association’s Responsibility – The Association shall maintain and keep in good repair the Common Area, and the Additional Maintenance Area, such maintenance funded as hereinafter provided. This maintenance shall include, but not limited to, maintenance, repair, and replacement, subject to any insurance then in effect, of all landscaping and other flora on the Common Area, and structures, and improvements situated upon the Common Areas, and the Additional Maintenance Area, as set forth fully in Article VIII.
Article IV, Section 2. Owners’ Responsibility – In accordance with this Declaration, and except as provided in Article VIII, all maintenance of the interior portions of the Residential Unit, all structural components of the Residential Unit, and other improvements not maintained by the Association shall be the responsibility of the Owner thereof.
Article VIII, Section 2 (a) Additional Maintenance Obligations – The Association also shall maintain the exterior of each Residential Unit as follows: painting, maintenance, and non structural repair of exterior building surfaces, trees, shrubs, grass, walks, replacement of trim, caulking and other repairs to roof covers (to include the repair and replacement of all non-structural components of the roof of each Residential Unit), and other miscellaneous repairs of a nonstructural nature.
Article XIII, Section 4. Weatherproofing – Notwithstanding any other provisions of this Article, an Owner who by his negligent or willful act causes the party wall to be exposed to the elements shall bear the whole cost of furnishing the necessary protection against such elements.
Article XIV, Section 1. Damage and Destruction – Duty to Rebuild. If all or any portion of any residence constituting a part of a Residential Unit is damaged or destroyed by vandalism, malicious mischief, fire, windstorm or other casualty, it shall be the duty of the Owner of said residence to rebuild, repair, or reconstruct said residence in a manner that will restore it substantially to its appearance and condition immediately prior to the casualty.
In accordance with these covenants and by-laws, The Association’s responsibility is limited to the outside surface of the Unit. The Association is pursuing an insurance claim related to damages covered under our policy. If a Homeowner has inside damage, they need to pursue their individual insurance policy.
If a Homeowner occurs damage from the roof, window or door, the Owner must notify Gasser Property Management within 10 days of the damage.
UNFINISHED/OLD BUSINES
1. Units 604 and 654 have been issued a court date for failure to pay association dues.
2. Units 659 and 684 are in arrears of dues to the Association dues of $500 or more.
HOMEOWNER REMINDERS
1. Please Move Your Trash Bin
A few Homeowners are leaving their trash bins in front of their unit all week. This is unsightly for the neighborhood and your immediate neighbors. Please return your trash bin to inside the garage or to the rear of your unit by no later than Wednesday morning. If you are going to be out of town, ask your neighbor. Homeowners failing to comply with this request will be fined $20 for each instance.
2. Franklin Recycling Program
Beginning in July, the City of Franklin will begin a voluntary recycling program. This requires little effort and the recyclable materials will be picked at the curb on Monday, along with your regular trash. To get more information, go to franklin.gov, click on “your government”, the “solid waste” and then “blue bag recycling”.
